It is a legal requirement to provide swimming pool isolation fencing to an inground or above ground pool capable of being filled with water to a depth of 300 millimetres or more.

These requirements also apply to any inflatable swimming pools sold through department stores.

It is important to remember that while fencing may assist in reducing drownings in backyard pools, the most effective way to prevent drownings is for children to be adequately supervised by a parent or other responsible adult.

Swimming Pool Compliance Certificates

As of 29 April 2016 you will need a certificate of compliance before you can sell or lease a property with a pool.

Considering building a new pool?

A Complying Development Certificate or a Development Application/Construction Certificate is required prior to the construction or installation of any new swimming pool.

The owner of a property is responsible for ensuring appropriate consent is obtained for the installation of a swimming pool.

Owners must ensure pool fencing complies with the Swimming Pools Act 1992, the Swimming Pools Regulation 2018 and Australian Standard AS 1926.1 - 2007. (Council officers may issue a Penalty Infringement Notice or a Notice to direct an owner to comply with these legislative requirements).
