UPDATE ON STATUS OF OBERON'S LEGAL CHALLENGE

Update on status of Oberon’s legal challenge against the NSW Minister for Local Governments’ proposal to forcibly merge Oberon and Bathurst Regional Council

At last night’s meeting council unanimously resolved to exercise its legitimate rights and lodge a formal appeal in the Supreme Court against the adverse decision handed down on October 7 2016 by Judge Preston in the Land and Environment Court. At that time council lodged an “Intention to appeal” this three month appeal right expires on January 7 2017. 

Council have taken this decision after careful consideration of sound advice from our legal team and the results of the recent community survey, where the community again endorsed continuation of the legal challenge through the court. 

Cabonne Council has also resolved to officially lodge an appeal therefore cost burdens will be shared.  I thank the people of Oberon and beyond for their continued support through this process and commit to keeping the community fully informed as the matter proceeds through the legal system.
